Welcome to PicShots (the "App"). These Terms of Service ("Terms") govern your access to and use of our App and services (collectively, the "Services"), which utilize artificial intelligence ("AI") to generate, transform, or enhance visual content. Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you are under 18 (or the age of majority in your jurisdiction), you represent that you have your parent’s or legal guardian’s permission to use the Services, and they have read and agree to these Terms on your behalf.

3. Privacy

4. User-Generated Content

(i) Your Content: You retain ownership of the photos you upload ("Your Content"). You are solely responsible for Your Content and its legality.

(ii) License to Us: By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and process Your Content solely for the purpose of providing, improving, and securing the Services (e.g., generating AI outputs, technical processing, and moderation).

(iii) AI-Generated Output: Content created by the App's AI based on Your Content or prompts ("AI Output") is provided for your personal, non-commercial use. We do not claim ownership of the AI Output you generate, but your use of it must comply with these Terms.

5. Prohibited Conduct and Content

You agree not to upload, generate, or share any content that is, or use the Services to:

(i) Illegal, harmful, or abusive (e.g., harassment, threats).

(ii) Infringes any patent, trademark, trade secret, copyright, or other intellectual property right.

(iii) Sexually explicit, pornographic, or exploitative of minors.

(iv) Fraudulent, deceptive, or misleading.

(v) Designed to impersonate any person or entity.

(vi) Contains malicious code or interferes with the Services' operation.
(vii) We reserve the right to remove any content and suspend or terminate your access for violations.

6. Limited License; Copyright and Trademark

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. All rights, title, and interest in the App, its software, design, logos, and trademarks are and will remain our exclusive property.

7. Feedback

Any feedback, comments, or suggestions you provide regarding the Services is voluntary. You grant us a perpetual, irrevocable license to use such feedback for any purpose without compensation to you.

8. Intellectual Property

The Services, including its "look and feel," original content, features, and functionality, are owned by us and are protected by international copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Services or any content owned by us, except for the limited license stated above.

We respect the intellectual property rights of others. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI OUTPUTS ARE GENERATED BY MACHINE LEARNING MODELS AND MAY BE INACCURATE, INCOMPLETE, OR OFFENSIVE. YOU USE THE SERVICES AND ANY AI OUTPUT AT YOUR OWN RISK.

11. Transfer and Processing Data

Your data, including Your Content, may be transferred to and processed in countries other than your own, where data protection laws may differ. By using the Services, you consent to this transfer and processing. We will take all steps reasonably necessary to ensure your data is treated securely as described in our Privacy Policy.

12. Governing Law and Venue

14. Subscription

14.1 PicShots is free to download. Premium features—such as AI-powered photo and video creation, enhancement, and generation features.

14.2 Subscriptions are available on a weekly or annual basis, with pricing displayed prior to purchase.

14.3 Payments are processed securely by Apple via your Apple ID account. Subscriptions renew automatically unless auto-renewal is disabled at least 24 hours before the current period ends.

14.4 Any unused portion of a free trial, if offered, will be forfeited upon subscription purchase.

14..5 You can manage or cancel your subscription at any time through your Apple ID Account Settings.

14.6 To Cancel: Open Settings > Apple ID > Subscriptions, select your subscription, and tap Cancel Subscription.

14.7 Refund Requests: Refunds must be requested directly through Apple. We may share relevant transaction details to assist in the process. All refund decisions are made at Apple’s discretion.

15. Termination

We may suspend or terminate your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services ceases immediately. All provisions of these Terms which by their nature should survive termination shall do so.
